The Office of Clerk of Superior Court has moved to the third floor of the new Hyde County Government Center, 30 Oyster Creek Road, Swan Quarter NC. The office hours of operation are 8:00 am to 5:00 pm, Monday through Friday.

The Clerk of Superior Court is a Constitutional Office and is elected to public service every four years through the county election process. This office is vital to the local administration of justice, and the job duties are diverse and complex with responsibilities that include the official record keeper of the District and Superior Courts of the county. The responsibilities of receipting and disbursing of monies received from court filings and fees are set by the General Statutes, along with those that govern the record keeping and fiscal responsibilities of the Clerk, and are assisted by the Administrative Office of the Courts in Raleigh. This is a state office, with salaries and equipment provided by the State of North Carolina. The Clerk is Judge of Probate in estates and administrations, and hears matters including land partitions, foreclosures, adoptions, incompetency and guardianship proceedings, name changes and other matters, as may be set by statute. The Clerk's office provides the service including the execution of passport applications, criminal record checks for county residents, and the administration of oaths of office. Public terminals are available for use in checking criminal and civil, judgements, estates and special proceedings cases. Subpoenas are issued for court appearances by this office as well as the acceptance of waivers of trial for highway and wildlife violations issued in this county.
